第二條、租賃客體

Article2. Object of the Lease 2.1 出租人出租其位于xxxx 的公寓。包括所有的附屬裝置、家具和電器 (以下統稱租賃房產)

The Landlord leases out the apartment located at xxxxx Including all fixtures, furniture and appliances (hereafter referred to as the leased property).

2.2 該租賃房產的總面積為xxx平方米。其中:臥室x 間,衛生間x,廚房x間,洗衣房 間,地下室 ,車庫 ;

花園面積 平方米,(包括草坪、花草、樹木、圍欄等)

Area of the leased property is xm2 ,in which there are bedroom x washing room x, kitchen x laundry , basement , garage , garden m2 with all appurtenances.

2.3 承租人有權使用出租人供所有承租人使用的共用面積。

The Tenant shall have the right to use the common areas shared by all tenants.

2.4 該租賃房產僅用于承租方指定人員居住,不得用于經營等其它用途。

The Tenant shall use the leased property only for residential purpose.

2.5 本合同附件一為房產證明或購房合同及業主身份證復印件(營業執照復印件)。

本合同附件二為家具、附屬裝置和電器的清單。

Copy of ownership Certificate of Leased Property or purchased contract of leased Property and copy of the landlords identity certificates (business license) is attached as Appendix I to this Contract.

The list of the furniture, fixtures and appliances in the leased property is attached as Appendix II to this Contract.)

第三條、租期

Article3. Lease Term 3.1 租期為1年,自x xxx 起,至xxxxx日止。

The lease term is for xx year, commencing on xxx,expiring on xxxxx

3.2 合同期滿后本合同終止,承租人若想延長租期,應在租期屆滿前的至少1個月書面通知出租人。

Should the Tenant want to extend the lease term, he shall notify the Landlord in writing not later than 1 month before the expiration of the lease term.

第四條、租金與支付條款

Article4. Rent and Terms of Payment

4.1 租金應為未稅每月xxxx RMB,租金每半年支付一次。

每月房租包括:發票稅金xxx,物業管理費xxx元,有限(數字)電視的安裝和使用費xxx元,寬帶安裝和使用費xx元,中介費用xx元,車位費xxx元,水電氣費xxxx元,一年內超出限額部分的水、電、煤氣費用由承租方支付。

The rent shall be xxRMB without tax per month. The rent shall be paid six month. The monthly rent should include official tax RMBxxx ,the Management Fee RMB xx, the TV installation fee and using fee RMB xxx, the broadband installation fee and using fee RMBxx, agency fee RMB 0, and utility fee such as: water, electrical and gas fee RMB xxx which will be balanced by year. The extra utility fee over the above mentioned limitation should be paid by the tenant.

Payment shall be effected through bank transfer.

第五條、管理服務與管理費

Article5. Management Services and Management Fee

出租人應對該租賃房產進行維護。管理費用包括,但不限于,建筑物內外的公共用地的清掃、對指定的垃圾箱內垃圾的清除,該地區電線和管道設施維護的費用。

The Landlord shall conduct maintenance on the leased property. The management fee includes, but is not restricted to, the cleaning of common areas, garbage removal from designated dustbins, maintenance of electric wiring and plumbing facilities on the area.

第六條、稅費

Article6. Taxes and Fees

出租人應支付政府部門向其征收的除租房稅金外的所有稅費。

The Landlord shall pay all taxes and fees levied on him by the authorities except the rent tax.

第七條、租賃房產的狀況

Article7. Status of Leased Property 7.1 出租人應不遲于租期的第1(大寫:壹 )天將該租賃房產以清潔、良好的狀態移交給承租人,并在移交的同時交

出該租賃房產的鑰匙。

The Landlord shall deliver the leased property to the Tenant in a clean and good condition no later than on the 1st (in words: first) day of the lease term. The Landlord shall hand over keys of the leased property at the time of delivery.

7.2 出租人在任何時間都應使該租賃房產保持良好的狀態。出租人應對房產的結構及各項設施和設備 進行維護,

并在出現問題的情況下及時糾正或維護;如果出租人沒有在合理時間內但不遲于接到通知后的一個星期內糾正該問題,則承租人有權請求賠償和/或糾正該瑕疵,費用由出租人承擔,承租人應向出租人提供所付費用的資料和收據。30天內未能解決,承租人有權立即搬出此房,并不承擔任何賠償。

The Landlord shall at all times keep the leased property in good condition. The Landlord shall provide maintenance to the property and repair defects such as: cracks on the wall in a structure; electric appliance works unproperly; construction against the local or compound regulation. If the Landlord fails to correct defects within due time but not later than 1 week after being notified, the Tenant shall have the right to claim damages and or correct the defects at the expense of the Landlord. The Tenant shall provide the Landlord with documentation and receipts of costs incurred. There shall be no penalty provided it cannot be solved in 30 days, and The Tenant has the right to check out.

7.3 在非因承租人過錯租賃房產出現問題的情況下,比如,但不限于空調故障,出租人應在收到承租人的通知后毫

不遲延地進行維修或糾正。 如果出租人未能及時解決問題,則承租人有權自行或聘請第三方進行維修,維修產生的費用由出租人承擔,承租人應向出租人提供所付費用的資料和收據。同時,出租人應向承租人賠償維修費用以外的其他損失(若有)。

In case of any problem of the Premises not arising from the Tenants fault, including but not limited to a

defective air conditioner, the Landlord shall carry out remedy or repair without delay upon receiving a notice from the Tenant. If the Landlord fails to resolve such problems within due time (not later than 1 week after being notified), the Tenant shall have the right to have it repair by itself or any third party at the expense of the Landlord. The Tenant shall provide the Landlord with documentation and receipts of costs incurred.

Meanwhile, the Landlord shall indemnify from the Tenant any other loss in addition to the repair fees, if any.

第八條、使用規則

Article8. Rules of Occupancy

承租人應遵守下列使用規則:

The Tenant shall follow the rules of occupancy as follows: 8.1 承租人只應將該租賃房產作為其住處。

The Tenant shall use the leased property only for residential purpose.

8.2 承租人有義務杜絕在租賃房產內從事任何會對其他承租人或出租人造成不合理干擾的活動。

The Tenant shall not allow anything to be done on the leased property that would unreasonably disturb other tenants or the Landlord.

8.3在租賃期間,承租人應有義務使該租賃房產保持干凈和良好的條件。正常的損耗應指在承租人及其家人的正常和合理使用期間產生的損耗。

The Tenant shall have the duty to keep the leased property clean and in a good condition for the duration of the lease term. Fair wear and tear shall mean such wear in the house is exposed to during the normal and reasonable use by a Tenant and Tenants family.

8.4 承租人如果發現租賃房產中的供電、煤氣或供水設施、電線或管道已證明有危險或可能證明有危險,應毫不遲

延地書面通知出租人。

The Tenant shall give written notice to the Landlord without delay when the Tenant becomes aware of any electrical, gas or water installation, wiring or piping on the leased property that proves to be, or may prove to be, a danger.

8.5 承租人應當補償出租人因更換或修理被承租人或承租人負責的人損壞或破壞的租賃房產中的任何用物而導致

出租人的所有直接費用。出租人必須能夠提供有關文件和正式發票以要求付款。正常的損耗不應構成任何該損壞或破壞。
