第六條交付期限乙方應在收到該房屋全款之日起日內將該房屋產權證交付乙方,第七條乙方逾期付款的違約責任,自本合同約定的到期日第二日起至實際付款之日止,按月計息。
2。逾期不履行的,視為乙方未履行本合同。屆時,甲方有權要求乙方承擔違約責任。
(1)本合同終止時,乙方應按累計應支付金額的百分之十向甲方支付違約金,當甲方實際經濟損失超過乙方支付的違約金時,實際經濟損失與違約金的差額,由乙方賠償。
(2)乙方按%支付違約金,并繼續履行合同。第八條甲方逾期交付房屋的違約責任。除不可抗拒的自然災害等特殊情況外,甲方未在本合同第六條規定的期限內將該房屋交付乙方使用的,乙方有權按已付價款向甲方追償違約利息。自本合同規定的交貨期第二天起至實際交貨之日止,月利息為月內月利率計算,月利息按月利率計算。
2。逾期-如甲方不履行本合同,乙方有權按下列條款履行本合同,甲方應承擔違約責任。
(1)本合同終止時,甲方應向乙方支付乙方累計支付的違約金,乙方實際經濟損失超過甲方支付的違約金時,實際經濟損失與違約金的差額由甲方賠償/(2)甲方應按累計支付金額向乙方支付違約金,乙方應繼續支付履行本合同的違約金。
第九條產權登記協議
自乙方實際接管該房屋之日起,甲方應協助乙方在不動產產權登記機關規定的期限內向不動產產權登記機關辦理權屬登記手續。如因甲方原因導致乙方未能接管本合同,乙方在日內取得房地產權證的,乙方有權退房。甲方應自乙方要求退房之日起計算,乙方應在日內將乙方支付的款項退還乙方,并按%賠償乙方損失。第十條甲方保證交易時該房屋不存在產權糾紛,并在交易前完成抵押、抵押債務、稅金、租金等。交易完成后,甲方對上述事項承擔全部責任。第十一條房屋所有權轉讓產生的土地增值稅由甲方向國家繳納,契稅由乙方向國家繳納;其他房屋交易產生的稅費,除另有約定外,由甲、乙雙方按政府規定另行繳納。第十二條水費、電費、煤氣費、物業費、采暖費等費用的交接日期為年、月、日。第十三條甲方聲明和保證:甲方有權簽署并能夠履行本合同。
2。在簽訂本合同時,任何法院、仲裁機構、行政機關或監管機構均未作出足以對甲方履行本合同產生重大不利影響的判決、裁定、裁決或具體行政行為。
